Article 2 of the Berne Convention allows Governments to legislatively exclude the Berne Convention from applying to Government Works. However, Governments are protected through the Berne Convention in works they create by default. This is stated in Article 2, Paragraph (3) of the Berne Convention Treaty.
Article 11bis, Paragraph (1) and Article 11ter, Paragraph (1) further state that the author has the sole right of broadcast authorization and that permission to broadcast does not include permission to record.
According to Oxford, literary has a definition of writing valued for quality of form and writing having a marked style intended to create a particular emotional effect.
